“There has been a delay in making partial payments to creditors as the Liquidator has been advised that until the Government of the Commonwealth of The Bahamas pass an amendment to the International Business Companies Act (IBC Act), to deal with companies that were delinquent in paying annual company fees and were struck off the Companies Register to be official restored once fees are paid up-to-date. It shall be noticed that the Liquidator has paid all HGS Inc. company’s fees up-to-date. Any payments made before this is done would be illegal. The Liquidator will keep creditors informed as news becomes available. The Liquidator is hopeful that this matter will be resolved this year.”

Die Teilauszahlungen an die Glaeubiger wird sich verzoegern. Der Liquidator wurde von der Regierung der Commonwealth der Bahamas aufgefordert vorerst keine Zahlungen zu leisten bis ein Nachtrag zum derzeit geltenden Unternehmensgesetz (IBC Act) rechtsgueltig ist. In diesem Nachtrag soll man Unternehmen, welche mangels Zahlung der jährlichen Registergebühren vom Handelsregister gestrichen wurden, die Möglichkeit geben bei nachtraeglicher Zahlung wieder ins Handelsregister eingetragen zu werden. Zur Klarstellung muss gesagt werden, das der Liquidator alle Gebuehren der HGS Inc. bis zum heutigen Tage entrichtet hat. Solange dieser Gesetzesnachtrag nicht rechtskraeftig ist, darf der Liquidator keine Auszahlungen veranlassen, da dies Illegal waere. Sobald sich etwas neues ergibt wird der Liquidator entsprechende Informationen bekannt geben. Der Liquidator ist aber guter Hoffnung das dieser Fall noch in diesem Jahr abgeschlossen werden kann.

“ Today, Monday 14th December, letters were mailed to creditors admitting their claims in the liquidation of Hofschildt Global Select, Inc. The Liquidator is in negotiations with the Liquidators of Suisse Security Bank & Trust (In Compulsory Liquidation) for the settlement of various marketable securities held and or sold by them that were invested through them in trust for Hofschildt Global Select, Inc., and should have been excluded from the other assets of the bank. Should these negotiations succeed the liquidator hopes to make a first dividend payment to creditors early in the New Year (2010).”

Glaeubiger werden darin aufgefordert die Dokumente entsprechend auszufuellen und durch ein bahamaesisches oder britisches Konsulat beglaubigen zu lassen so wie diese an den Liquidator moeglichst bald zurueck zu senden. "

Today, October 10, 2006 I have received notice from the office of the Provisional Liquidator, Mr. Raymond Winder, that a date has now been set to hear the winding-up application by the Central Bank of The Bahamas of Suisse Security Bank & Trust Limited. The petition is schedule to be heard on November 13th & 14th, 2006 at 10:00 a.m., before the Honorable Mr. Steven Isaacs in the Supreme Court of the Commonwealth of the Bahamas.

As you are aware, the liquidation of Hosschildt Global Select, Inc. was at a stand still as the remaining assets are all with Suisse Security Bank & Trust Limited.
Despite the fact that the Privy Council ruled against the petition of Suisse Security Bank & Trust Limited to prevent the Central Bank of The Bahamas placing it into liquidation earlier during the year, we still have to wait until the Official Liquidator is appointed.
The Official Liquidator would have the full authority of the Supreme Court of the Commonwealth of Bahamas to search for assets of Suisse Security Bank & Trust Limited and to take all steps necessary to recover those assets worldwide for the benefit of the creditors.
This process could take sometime and at the moment it would be uncertain to predict a time when I would be in possession of any assets to distribute to the creditors of Hosschildt Global Select, Inc.

Letter From Liquidator of Suisse Security Bank & Trust Limited (in liquidation)

Dear Creditors/Depositors:
As you are aware, Mr. Raymond Winder was appointed as the Official Liquidator of Suisse Security Bank and Trust Limited (“the Bank”) on 13th November 2006. As the Official Liquidator, he along with his Attorneys continue to pursue a large portion of the Bank’s assets, which remain under the control of the former management, directors and shareholders of the bank. Presently, it would not be prudent to discuss the steps that are being taken at this time.
It should be noted however, that the Supreme Court of the Commonwealth of The Bahamas (“the Court’) was notified by attorneys for some of the bank’s creditors of their intention to form a Creditors Committee (“Committee”). In light of this, on 18th December 2006, a Summons and an Affidavit were filed applying for a Court Order to appoint a Committee, to expedite the progress of the liquidation and the timely completion of the Official Liquidator’s duties. Further, if this committee is formed, it would have limited powers, if any. This Committee ought to operate as an advisory Committee which would give the Liquidator advice and their opinion. Mr. Mohamed Harajchi, Mr. Derek Ryan and Mr. Christopher Lunn have applied to the Court to be included as members of this Committee. Their inclusion has been opposed and therefore, the matter is scheduled for hearing on 6th June 2007 to determine whether or not they would be allowed to serve on the Committee.
In closing, the deposits remain frozen and we are unable to comment on the likelihood of funds being recovered at this time. However, as soon as information is available, the same will be disseminated to all creditors and depositors of the Bank.

Als Sie bewusst sind, wurde Herr Raymond Winder als der Offizielle Liquidator von Suisse Sicherheitsbank ernannt und Vertrauen Hat („die Bank“) am 13. November 2006 Begrenzt. Als verfolgen der Offizielle Liquidator, er zusammen mit seinen Rechtsanwälten weiter einen großen Anteil der der Bank die Vermögenswerte, die unter der Steuerung von der ehemaligen Leitung bleiben, die Direktoren und die Aktionäre von der Bank. Gegenwärtig wäre nicht es klug, die Sgenommen werden.
Es sollte aber gemerkt werden, dass der Oberste Gerichtshof vom Gemeinwesen von Den Bahamas („dem Gerichtshof‘) von Rechtsanwälten für etwas von den Gläubigern der Bank von ihrer Absicht benachrichtigt wurde, ein Gläubigerkomitee („Komitee“) zu bilden. In Licht von dies am 18. Dezember 2006, eine Vorladung und eine Eidesstattliche Versicherung wurde beantragen ein Gerichtsbeschluss abgelegt, ein Komitee zu ernennen, den Fortschritt von der Liquidation und der rechtzeitigen Vollendung von den Pflichten des Offiziellen Liquidators zu beschleunigen. Weiter, wenn dieses Komitee gebildet ist, es hätte Kräfte, wenn irgendein begrenzt. Dieses Komitee soll als ein Beirat bedienen, der den Liquidator Rat und ihre Meinung geben würde. Herr Mohamed Harajchi, Herr Derek Ryan und Herr Christopher Lunn haben für den Gerichtshof gegolten, als Mitglieder von diesem Komitee miteingeschlossen zu werden. Ihre Einbeziehung ist entgegengesetzt worden und daher, die Materie ist für Hören am 6. Juni 2007 geplant zu bestimmen, egal ob sie erlaubt werden würden, auf dem Komitee zu dienen.
Beim Schluss bleiben die Einzahlungen gefroren und wir sind unfähig, auf die Wahrscheinlichkeit zu kommentieren, dass der Fonds, zurzeit wiedererlangt zu werden. Jedoch, sobald Informationen zur Verfügung steht, wird das gleiche zu allen Gläubigern und Hinterlegern von der Bank verbreitet werden.

BAHAMAS COURT HEARING
The only news that I have on the liquidation is that the Bahamas Supreme Court denied the request for a Creditors Committee and placed a restraining order on Mr. Harachi and his wife from selling or disposing of their home and other assets in The Bahamas, until all assets of Suisse Security Bank & Trust Limited (In Liquidation) has been recovered and accounted for by the Liquidator.
The Harachi’s are the owners of SSBT, where the deposits of HGSI were held. Because of this, there is no progress in the liquidation as the Liquidator of SSBT is seeking to recover monies from the Harachi’s before any monies can be paid to creditors.
I cannot pay any monies to the creditors of HGSI until I receive payments from the Liquidator of SSBT, as those deposits at SSBT are the only assets owned by HGSI.

Die einzigen Nachrichten, die ich auf der Liquidation habe, ist, dass die Bahamas Oberster Gerichtshof die Bitte für ein Gläubigerkomitee verweigert hat, und hat eine Zurückhaltungsreihenfolge auf Herrn Harachi und seine Ehefrau von Verkauf gestellt oder verfügend über ihr Heim und andere Vermögenswerte in Den Bahamas, bis alle Vermögenswerte von Suisse Sicherheitsbank & Vertrauen Begrenzt (In Liquidation) wiedererlangt worden ist, und ist durch den Liquidator erklärt worden.
Des Harachi ist die Eigentümer von SSBT, wo die Einzahlungen von HGSI gehalten wurden. Wegen dies gibt es keinen Fortschritt in der Liquidation, während der Liquidator von SSBT sucht, monies von des Harachi wiederzuerlangen, bevor irgendein monies zu Gläubigern bezahlt werden kann.
Ich kann den Gläubigern keinen monies von HGSI bezahlen, bis ich Zahlungen vom Liquidator von SSBT empfange, als die Einzahlungen an SSBT die einzigen Vermögenswerte sind, die von HGSI besessen werden.
Mitteilung über Eingang eines Konkurseröffnungsantrags für Suisse Security Bank & Trust Limited
Heute, am 10. Oktober 2006, wurde mir im Namen des einstweiligen Insolvenzverwalters Raymond Winder mitgeteilt, dass nun ein Anhörungstermin für den Konkurseröffnungsantrag der Central Bank of The Bahamas bezüglich der Suisse Security Bank & Trust Limited vorliegt. Die Anhörung soll am 13. und 14. November 2006 jeweils um 10:00 Uhr vor dem Richter am Supreme Court of the Commonwealth of the Bahamas Steven Isaacs stattfinden.

Wie Sie wissen, stockt die Liquidation von Hosschildt Global Select, Inc. derzeit, weil alle verbleibenden Vermögenswerte bei der Suisse Security Bank & Trust Limited liegen.
Obwohl der Privy Council dem Antrag der Suisse Security Bank & Trust Limited in der ersten Jahreshälfte nicht stattgeben konnte, die Eröffnung eines Konkursverfahrens bezüglich der Suisse Security Bank & Trust Limited durch die Central Bank of The Bahamas zu verhindern, sind uns die Hände gebunden, bis ein offizieller Insolvenzverwalters bestellt ist.
Ein solcher „Official Liquidator“ ist durch das Supreme Court of the Commonwealth of the Bahamas bevollmächtigt, die Vermögenswerte der Suisse Security Bank & Trust Limited zu erfassen und alle erforderlichen Maßnahmen zur Sicherstellung dieser Vermögenswerte im In- und Ausland zugunsten der Gläubiger zu ergreifen.
Dieser Vorgang kann geraume Zeit in Anspruch nehmen, daher lässt sich derzeit nicht mit Sicherheit sagen, ob und wann ich in den Besitz von Vermögenswerten zur Verteilung unter den Kreditoren der Hosschildt Global Select, Inc gelangen werde.
